Terms of service
☆ IMPORTANT ☆
General:
☆ I have the right to reject any commission, trade or request offer for any reason.
☆ What I WILL Do: Furry Anthro, femme preferred but I can do masculine. SFW, Soft NSFW is okay. Feel free to ask, worst I can say is no!
☆ What I WON’T Do: Extreme fetish, feral NSFW or complex mechanical designs.
☆ I will not tolerate harassment of any form; this include spamming, unsolicited sexual topics/discussion/imagery, aggressive/argumentative messages or threats.☆ By commissioning me, requesting from/trading with or adopting one of my designs you confirm you have read my T.O.S in full and understand all conditions.
Price:
☆ Prices will be discussed and mutually agreed to prior to any payment.
☆ Prices outlined in my general price guide are subject to change based on complexity of commissions and special offers.
☆ Do not attempt to haggle my prices.
Payment:
☆ Commissions can be either paid 100% upfront or split into two 50% payments; one half paid at the beginning of the service and the other half paid after the draft approval. Work will not continue past the drafting period until the remainder of payment is received.
☆ Currency accepted: USD only through PayPay only.
☆ Do not send any payment before I have requested you to send payment.
☆ All costs will be discussed and mutually agreed to prior to payment.
Process And Delivery:
☆ Your commission will be completed within 1 week to 3 months depending on factors such as complexity, health and workload.
☆ You will receive updates as I work where possible, my Trello will be updated frequently for you to track progress.
☆ Upon completion of your commission, you will be emailed a full resolution image of the finished product.
Revisions:
☆ Drafts will be provided to you for approval before I begin to work on the final product. If you decide to make changes to the content of your commission, eg; add characters, change/add to background or alter details after the drafting period, you will be charged for the additions.
☆ Any changes you decide to make during the drafting period will not result in additional cost provided that they do not significantly increase the complexity of the commission.
☆ Changes to the design after the drafting period may result in additional costs depending on their complexity.
Requests and Trades:
☆ Requests and trades are strictly available only as I offer them.
☆ Requests do not include access to layers or time-lapses, these are available at cost or with paid commission.
☆ As there is no monetary incentive, no timeframe is guaranteed and other projects will be prioritised over trades and requests.
☆ I reserve the right to back out of a Request or deny it for any reason.
☆ Any Trade I agree to enter is done so with the expectation of receiving art of similar quality.
☆ If a Trade is not honored and I do not receive in return, I reserve the right to use the artwork I created for profit, given that I alter/remove the likeness to any Original Character/s I do not own.
☆ Do not spam me regarding the progress of your trade or request.
☆ I reserve the right to post all art I create with appropriate credit where possible to social media.
ADOPTABLES:
☆ If you purchase a design from me, you may edit/change the design unless otherwise specified.
You must credit me as the original creator.
☆ You are free to resell the design for no more than the original cost unless the design is accompanied by additional artwork.
☆ If you have not paid in full for the design, you are not permitted to sell or trade the design.
☆ I do not accept returns or refunds on adoptable designs, please do not purchase if you are not in the financial position to buy.
☆ If you have entered a payment arrangement and you cancel this arrangement, you will not be refunded and the design will be relisted for sale.
Colouring Pages and Bases:
☆ If you have purchased a colouring page or base, you may colour and finish the piece/s yourself; you may even commission someone else to colour it for you.
☆ Please disclose appropriate credit when posted
Copyright and Usage:
I, Baphoheck (the artist)
☆ I reserve the right to cancel and refund the order at any time for any reason.
☆ I retain all copyrights over the commissioned artwork.
☆ I will NOT claim the intellectual property (IP) of the commissioned artwork or characters I do not own.
☆ I will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
☆ I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.You (the customer/commissioner)
☆ You may upload the commissioned artwork on any website or social media with appropriate credit.
☆ You may NOT make profits from the commissioned piece (reselling, redistributing, uploading to POD-services, make prints, etc.) unless commercial rights to the artwork have been purchased.
☆ You may NOT alter the commissioned artwork without my (the artist's) consent; this includes removing my signature.
☆ You may NOT claim the artwork as your own.
☆ You may NOT feed the commissioned artwork into AI (Artificial Intelligence) in ANY way.
☆ You may NOT mint/sell the commission as an NFT.
☆ You MAY be allowed to sell the artwork if it is a part of an Adoptable. Please discuss this with me prior to paying for the artwork.
☆ You retain the rights to the intellectual property (IP) within the commission; e.g, characters/designs that you own.
☆ You may NOT use the commissioned artwork for commercial purposes unless commercial rights have been purchased.The following is considered copyright infringement:
☆ Reproducing/using the copyrighted artwork commercially - meaning making money off it in any way not excluded from these terms.
☆ Claiming the artwork as your own.
☆ Altering the artwork without my consent.Commercial Use:
☆ In some cases, the commercial rights to the image/artwork may be purchased, allowing you to profit from the commissioned piece.☆ If you have purchased commercial rights to the image/artwork, you will be provided with an unsigned version of the commission; however, appropriate credit will still be expected where possible.☆ The cost of purchasing commercial rights will be discussed and agreed to prior to sale.
Cancellations & Refunds:
☆ The buyer is not allowed a refund once I started working on the commission.
☆ If for any reason I am unable to start your commission you will receive a full refund.
☆ If you cancel your order before I started it, you can get a full refund.
☆ If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.
☆ If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.
VIOLATION OF THE ABOVE TERMS WILL RESULT IN BEING BLACKLISTED
